Return and Refund policy

This Return and Refund Policy is taken from, and forms an integral part of, the LOFI MERCH General Terms and Conditions of Sale. The original text was written in French. All terms beginning with a capital letter shall have the meaning assigned to them in the General Terms and Conditions of Sale. In the event of translation and of any discrepancy between the different versions, the French version shall prevail.

1. Right of withdrawal

 

1.1 Applicability of the right of withdrawal

Pursuant to articles L.221-18 et seq. of the French Consumer Code, following an online Order, the Customer has a period of fourteen (14) days, from the date on which the Customer or a third party designated by the Customer receives the Products that are the subject of the Order, to exercise the right of withdrawal. If the period expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next business day. If the Customer has placed an Order for several Products delivered separately, or in the case of an Order for a Product made up of multiple lots or pieces delivered in stages, the period runs from the receipt of the last item, lot or piece.

In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal is excluded for the following products:

  • products liable to deteriorate or expire rapidly;
  • products that have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection;

1.2 Where the Customer’s right of withdrawal applies

To exercise your right of withdrawal, please notify your decision to withdraw by means of an unambiguous statement expressing your wish to withdraw:

  • by direct message: via the live chat box available on the Site.

The Customer may use the withdrawal form appended hereto, in accordance with article L. 221-1 of the French Consumer Code. In order for the fourteen (14) day withdrawal period to be observed, the communication relating to the exercise of the right of withdrawal must be sent before the expiry of that period. In the case of a postal dispatch, the dispatch date shown on the postmark shall prevail. Once your wish to withdraw has been communicated, the Products must imperatively be returned to the address indicated by Customer Service within a maximum period of fourteen (14) days after you have communicated your decision to withdraw. The Customer must bear the cost of returning the Products, unless otherwise indicated by Customer Service.

Only the Customer who placed the Order may exercise this right of withdrawal. In the event of delivery to a different person, this right may not be exercised by the recipient of the Order.

1.3 Refund terms

LOFI MERCH shall refund all sums paid by the Customer, with the exception of return shipping costs and, where applicable, any additional cost resulting from the choice of a delivery method more expensive than the standard method, at the latest within fourteen (14) days following receipt of the returned Products or receipt of proof of dispatch by the Customer, if the latter is provided earlier.

The refund is made using the same means of payment as that used for the initial Order, unless the Customer expressly agrees to another means. It does not give rise to any cost for the Customer. The time taken for the refund to appear on the Customer’s bank account depends on the practices of their banking institution and cannot be attributed to LOFI MERCH.

LOFI MERCH reserves the right to deduct from the refund any depreciation resulting from handling of the Products beyond what is necessary to establish their nature, characteristics and proper functioning, in accordance with article L.221-23 of the French Consumer Code.

 

2. Right to cancel or modify the Order

The Customer may cancel or modify their Order by sending a request to Customer Service. The Customer’s right to modify or cancel may be exercised as long as the Product has not yet been shipped.

The Seller undertakes to refund the Customer the full price paid. LOFI MERCH will refund the sums paid within a maximum period of fourteen (14) days from the cancellation request, in accordance with the same refund terms as set out in article 1.3 above.
