ARTICLE 1 - PURPOSE & ORGANIZER OF THE SWEEPSTAKES

LOFI RECORDS, 23 bis Rue du Docteur Paul Bruel 95380 Louvres France, (hereinafter the "Organizing Company") is organizing a free sweepstakes with no purchase obligation (hereinafter the "Sweepstakes") as part of its collaboration with Assassin's Creed, under the conditions exclusively set forth in these Official Rules (hereinafter the "Rules"). In accordance with Articles L.121-36 et seq. of the French Consumer Code, this Sweepstakes is entirely free, with no purchase obligation, and open to any participant who complies with the conditions of these Rules. As part of this Sweepstakes, the Organizing Company will award three (3) winners (hereinafter referred to as the "Winner" or "Winners"), each three (3) prizes as defined in Article 5 of these Rules.

ARTICLE 2 - ACCESS TO THE SWEEPSTAKES

The Sweepstakes is accessible on Instagram, X (formerly Twitter), and Discord platforms on the official "LOFI GIRL" accounts between April 8, 2025 (6:00 PM CET) and April 13, 2025 (11:59 PM CET). The Sweepstakes requires no purchase and is open to any natural person worldwide with the exception of the following countries: North Korea, Iran, Syria, Cuba, Sudan, Crimea, Democratic Republic of Congo, Afghanistan, Belarus, Russia, Venezuela, and any other country subject to comprehensive international sanctions. Employees and representatives of the Organizing Company, its subcontractors and partners, as well as members of their families, are also excluded. The Sweepstakes is intended for persons of legal age according to the legislation of their country of residence. Any minor wishing to participate must provide parental authorization dated and signed to hello@lofigirl.com by the holder(s) of parental authority or legal guardians. The parent or guardian is responsible for the veracity of the participation. The Organizing Company reserves the right to request proof of this authorization at any time during the Sweepstakes and may cancel the participation of a minor participant whose legal representative does not validate the participation.

ARTICLE 3 - PARTICIPATION MECHANISMS

3.1 Participation conditions
To participate in the Sweepstakes, the Participant must perform the actions described below on one of the mentioned platforms (one participation per platform is allowed), a random drawing will take place on each platform:

On Instagram:

• Follow the @lofigirl account
• Like the Sweepstakes post
• Tag a friend in a comment under the Sweepstakes post

On X:

• Follow the @lofigirl account
• Like and retweet the Sweepstakes post

On Discord:

• Interact with the Sweepstakes post by clicking on the participation button

A Participant is authorized to participate once per platform (Instagram, X, and Discord), for a maximum total of three (3) participations. Each participation is independent: a Participant having correctly completed the actions on several platforms may be drawn on each of them. It is therefore possible for the same Participant to be designated a Winner on several platforms, and thus to win multiple Prizes, subject to compliance with the conditions defined in these Rules.

The participant's participation will be considered complete provided that all required actions on at least one of the platforms are cumulatively accomplished. The Organizing Company reserves the right to verify by any means that participants have participated in the Sweepstakes in accordance with these Rules. Any participation that does not meet the participation conditions or that contains an anomaly or inconsistency will be declared null and void and will not be taken into account by the Organizing Company. Participation in the Sweepstakes implies full and unreserved acceptance of these Rules, the terms of use of Instagram, X, and Discord social networks in force, as well as their community rules.

The Organizing Company uses automated third-party tools (such as app.wask.co and GiveawayBot) to ensure fairness, impartiality, and transparency of the random drawing. However, it cannot be held responsible in case of malfunction, technical error, breakdown, or questionable result related to the functioning of these tools, which are developed and maintained by independent companies. By participating in the Sweepstakes, each Participant acknowledges and accepts that the Organizing Company cannot in any case be held responsible for any software bug, algorithmic anomaly, or automatically generated result by the tools used. The use of these solutions has the sole objective of guaranteeing fair and non-discriminatory processing of participations, without human intervention in the selection of Winners.

The Rules can be consulted and printed at any time from the Sweepstakes posts and on the Organizing Company's store website https://lofigirlshop.com/pages/lofi-girl-x-assassins-creed and can be obtained upon simple written request to the following email address: hello@lofigirl.com.

3.2 Required information
Participation on at least one of the platforms (Instagram, X, or Discord) constitutes the only mode of registration for the Sweepstakes. No additional participation form is required. By performing the required actions on at least one of the required platforms, participants:

• Declare having read these Rules and accept their terms without reservation
• Agree to provide, upon request by the Organizing Company, proof of identity and a signed parental authorization for minors

In case of designation as a potential Winner, upon request, the participant must provide by private message:

• Their first and last names
• Their date of birth
• Their city and country of residence
• A valid email address
• A postal address and telephone number for Prize delivery, if applicable

ARTICLE 4 - RANDOM DRAWING & WINNER DESIGNATION

The designation of the three (3) Winners will be carried out by random drawing conducted on each platform with two third-party tools: (i) the app.wask.co tool will be used to conduct a random drawing on Instagram and a second drawing on X, (ii) the GiveawayBot tool will be used to conduct a random drawing on Discord. Each of the random drawings will be carried out among all participants having correctly performed the required actions on one of the platforms mentioned in Article 3.1. The random drawings will be conducted within five (5) business days following the close of the Sweepstakes.

Any decision regarding the designation of Winners and verification of participation conditions is final and cannot be contested. If all conditions are met, the Organizing Company will contact the randomly selected participants via private message on the platform used for their participation to notify them of their selection and request the required information and supporting documents. These documents will only be used to verify compliance with the Sweepstakes conditions and will be deleted within a maximum period of thirty (30) days after the validation of the Winners. Supporting documents must be transmitted within 72 hours after receipt of the message. After this deadline or in case of non-compliance of the documents, the participation will be automatically canceled, and a new random drawing will be conducted to designate another potential Winner. The Organizing Company will analyze the documents provided within 72 hours. It may, if necessary, request additional documents to verify the authenticity of the information transmitted.

If the Organizing Company confirms that the participant satisfies all eligibility and validation conditions, they will be designated as the final Winner and will be awarded the Prize according to the terms specified in Article 5 of these Rules.

ARTICLE 5 – ANNOUNCEMENT OF RESULTS, PRIZES & PRIZE DELIVERY

5.1 Designation and announcement of Winners
The designation of Winners will be carried out in accordance with the provisions of Article 4 of these Rules. After verification of their eligibility and compliance with participation conditions, the Organizing Company will officially announce the results within a maximum period of seven (7) days following the close of the Sweepstakes.

The names or pseudonyms of the Winners will be published on the official Lofi Girl accounts on Instagram, X, and Discord, and may be communicated by any other means deemed appropriate by the Organizing Company.

Winners will also be contacted by private message on the platform used for their participation (Instagram, X, or Discord). Winners will have a period of seventy-two (72) hours from the date of sending the notification to confirm acceptance of their Prize and provide the information necessary for its shipment. After this deadline, they will be considered as having renounced their Prize, which may be reallocated to another participant by a new random drawing.

5.2 Prizes
The three (3) Winners will each receive the following Prizes (3 Prizes per Winner and per platform):

• 1 Lofi Girl x Assassin's Creed Art Print valued at $79.99
• 1 Lofi Girl x Assassin's Creed Shadows Vinyl valued at $34.99
• 1 Digital key for the Assassin's Creed Shadows game valued at $69.99

The value of the Prizes corresponds to the estimated public price at the time these Rules were drafted and is provided for indicative purposes only, without possibility of claim in case of subsequent tariff variation.

5.3 Prize delivery methods
The shipment of physical Prizes (art print and vinyl) will be handled directly by the Organizing Company, to the address indicated by the Winners when confirming their win. For the digital game key, it will be sent by email to the address provided by the concerned Winner. Winners are solely responsible for the accuracy of the information provided. In case of incorrect or incomplete address, the Organizing Company cannot be held responsible for non-delivery of the Prize. In case of non-receipt of the Prize within a reasonable time, Winners should contact the Organizing Company.

For the Prize consisting of a digital key for the Assassin's Creed Shadows game, the following technical information applies:

• Compatible platform(s): PC, PlayStation 5, Xbox Series X/S
• Minimum required configuration (for PC version): Operating system WINDOWS 10 / 11 WITH DIRECTX 12 / CPU Intel® Core™ i7-8700K, AMD Ryzen™ 5 3600 / GPU Nvidia® GeForce GTX™ 1070 8GB, AMD Radeon™ RX 5700 8GB, Intel® Arc™ A580 8GB (REBAR ON) / RAM 16 GB Dual-Channel / Storage SSD - 106 GB
• Activation procedure: The Winner will receive by email a unique code as well as detailed instructions to activate the game on the corresponding platform
• Activation deadline: The code must be activated within 6 months after receipt
• Technical support: In case of activation difficulty, the Winner may contact Ubisoft customer service at https://www.ubisoft.com/en-us/help

5.4 Conditions and restrictions
The digital key for the Assassin's Creed Shadows game will be awarded in the form of an activation code for the gaming platform chosen by the Winner ([PlayStation, Xbox, PC or via Steam/Epic/Ubisoft Connect, etc.].
The Winner acknowledges that the use of this digital key may be subject to age, content, or availability restrictions in certain countries. The Organizing Company cannot be held responsible in case of impossibility for the Winner to activate their game key due to territorial restrictions imposed by the game publisher or by local legislation. In case of proven incompatibility, the Organizing Company may offer an alternative prize of equivalent value.

No exchange, refund, or financial compensation may be requested in replacement of the awarded Prize. Any resale or transfer of the Prize is strictly prohibited. In case of unavailability of a Prize for reasons beyond the control of the Organizing Company, it reserves the right to replace it with a Prize of equivalent or superior value, without possibility of contestation.

As the Prizes are awarded free of charge, no fees or taxes will be charged to the Winners, except for contrary legal provisions.

5.5 Tax Implications
The value of the Prizes awarded to Winners is indicated in US dollars, all taxes included. Winners are informed that these Prizes may, according to the tax legislation in force in their country of residence, be subject to declaration or taxation.
For French tax residents: In accordance with current regulations, Prizes received as part of this Sweepstakes may constitute a benefit in kind subject to tax declaration if their value exceeds the exemption thresholds provided by legislation. For tax residents of other countries: Winners are solely responsible for verifying with the tax authorities of their country of residence any declaration obligations related to obtaining these Prizes and paying, if applicable, any tax or duty that may be due. The Organizing Company cannot be held responsible for tax obligations incumbent upon Winners.

ARTICLE 6 – PUBLICITY & USE OF WINNERS' PSEUDONYMS

By participating in the Sweepstakes, Winners expressly authorize the Organizing Company to use and disseminate their Instagram, X, or Discord pseudonym to the exclusion of any other personal data, in communications related to the Sweepstakes and for promotional purposes. This authorization is granted free of charge, without the Winners being able to claim any remuneration or compensation in exchange for the exploitation of their pseudonym. Winners agree that their pseudonym may be disseminated, for the territory of the World, on the following supports:

• Social networks: Instagram, X, Facebook, YouTube, TikTok, and other official platforms of the Organizing Company
• Website: www.lofigirl.com
• Third-party media: press releases, promotional articles, and any communication support related to the Sweepstakes

This authorization is valid for a period of three (3) months from the date of announcement of the Winners. Winners retain the possibility to object to the publication of their pseudonym by submitting a written request to the Organizing Company at the following address: hello@lofigirl.com no later than within three (3) days following the announcement of the results.

ARTICLE 7: PERSONAL DATA – DATA PROTECTION NOTICE

As part of the organization of the Sweepstakes, the Organizing Company, acting as data controller within the meaning of the General Data Protection Regulation (Regulation (EU) 2016/679 – "GDPR"), collects and processes participants' personal data in order to manage their participation, identify Winners, award Prizes, and ensure the transparency of the Sweepstakes, particularly through the publication of the Winners' pseudonyms on the official "LOFI GIRL" accounts. This processing is based on the execution of these rules, in accordance with Article 6(1)(b) of the GDPR, and on the legitimate interest of the Organizing Company, pursuant to Article 6(1)(f) of the GDPR, for the communication of results and the management of accounting and tax obligations.

Participation in the Sweepstakes involves the collection and processing of the following data: pseudonym on social networks and, for Winners only, name, first name, date of birth, city and country of residence, as well as email address and postal address. This data is strictly necessary for the management of the Sweepstakes, and failure to provide it will result in the impossibility of validating participation or receiving the Prize. The personal data collected is intended exclusively for the Organizing Company and not for the social networks Instagram, X, or Discord, for the sole purpose of organizing and ensuring the proper conduct of the Sweepstakes as well as the awarding of Prizes. This personal data is not subject to any sale, transfer, or transmission to third parties for commercial or advertising purposes. However, the Organizing Company may transmit certain data to technical or logistical service providers, acting as processors within the meaning of the GDPR, to ensure, in particular, the random drawing, the hosting of the Sweepstakes site, and the delivery of Prizes. Participants' personal data is retained for the duration of the Sweepstakes and until the effective awarding of Prizes.

• Data of non-winning participants: deleted three (3) months after the close of the Sweepstakes
• Data of Winners: retained for up to six (6) months after the delivery of Prizes, except for legal obligation imposing a longer duration
• Data necessary for compliance with accounting and tax obligations: retained for five (5) years, in accordance with current legislation

The Organizing Company implements appropriate technical and organizational measures to guarantee a level of security adapted to the risk incurred for the rights and freedoms of participants.

In application of the GDPR and the amended French Data Protection Act of January 6, 1978, each participant has the following rights over their personal data: right of access, right of rectification, right of erasure (subject to legal retention obligations), right to restriction of processing, right to data portability, and right to object for reasons relating to their particular situation. Proof of identity may be requested to prevent any identity theft. Participants also have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) if they believe that their rights are not being respected.

ARTICLE 8: LIABILITIES & RESERVATIONS

The liability of the Organizing Company is strictly limited to the awarding of Prizes validly won in accordance with the provisions of these Rules. The Organizing Company cannot under any circumstances be held responsible for the consequences related to the use, enjoyment, or non-use of the Prizes awarded to Winners.

As the Sweepstakes is organized on Instagram, X, and Discord platforms, participants expressly acknowledge being subject to the terms of service of these platforms as well as their community rules in force. The Organizing Company cannot be held responsible for any suspension, deletion, or restriction of account decided unilaterally by these platforms due to a participant's breach of the rules in force. The Organizing Company cannot be held responsible for fraud, cheating, or unfair maneuvers committed by any of the participants. Any fraud, attempted fraud, cheating, or unfair maneuver aimed at altering the proper conduct of the Sweepstakes will result in the immediate exclusion of the concerned participant, without prejudice to possible legal proceedings.

The following are notably considered as fraud, without this list being exhaustive:

• Identity theft
• Use of fake accounts or bots
• Multiple participation under different identities
• Any form of manipulation aimed at artificially increasing one's chances of winning
• The Organizing Company reserves the right to conduct any necessary verification to ensure the fairness of participations. Any exclusion of a participant will be definitive and without possibility of appeal, except in case of manifest error by the Organizing Company.

The Organizing Company will strive to ensure continuous access to the Sweepstakes via its official accounts. However, it cannot be held responsible in case of interruption, suspension, or deletion of the Sweepstakes, particularly due to technical problems affecting the platforms, the Internet, or the hosting servers.

ARTICLE 9: FORCE MAJEURE AND EXCEPTIONAL CIRCUMSTANCES

The Organizing Company cannot be held responsible if, due to force majeure or circumstances beyond its control, the Sweepstakes must be modified, shortened, or canceled.

The following are considered cases of force majeure, within the meaning of these Rules, events presenting the characteristics of unpredictability, irresistibility, and externality, such as notably: Natural disasters, epidemics, fires, floods; Attacks, wars, civil or social unrest; Governmental or legal restrictions; Widespread power outages or telecommunications network failures; Closure or major modification of the platforms used for the Sweepstakes; Any other circumstance making the continuation of the Sweepstakes or the delivery of Prizes impossible or particularly difficult.

In the event of a force majeure event, the Organizing Company will inform participants as soon as possible and may, at its discretion, extend the duration of the Sweepstakes, modify certain terms, or cancel the Sweepstakes if circumstances require it.

ARTICLE 10: PUBLICATION & CONSULTATION OF THE RULES

These Sweepstakes Rules are established by the Organizing Company and made available to the public freely and permanently throughout the duration of the Sweepstakes. They can be consulted and downloaded at any time on the official website of the Organizing Company (https://lofigirlshop.com/pages/lofi-girl-x-assassins-creed) and can be obtained upon simple written request addressed to the Organizing Company by email at hello@lofigirl.com.

Any modification of the Rules will be the subject of an amendment, which will be published according to the same modalities as the initial Rules. A time-stamped and archived version of the Rules will be kept by the Organizing Company for evidentiary purposes and may be communicated to any participant in case of dispute.

ARTICLE 11: ACCEPTANCE OF THE RULES

Participation in the Sweepstakes implies unreserved and irrevocable adherence to these Rules, their clauses, and any possible amendments. Any fraud, attempted fraud, or failure to comply with the conditions defined in these Rules will result in the immediate exclusion of the participant, without prejudice to any legal proceedings that the Organizing Company might initiate against them.

ARTICLE 12: APPLICABLE LAW AND DISPUTES

This Sweepstakes and its Rules are exclusively governed by French law, subject to the mandatory laws of the participant's country of residence, when these grant them specific legal protection that cannot be set aside by foreign Sweepstakes Rules.

In accordance with the provisions of Article L.211-3 of the French Consumer Code, in case of a consumer dispute, the participant may refer the matter free of charge to the consumer mediator to whom the Organizing Company reports.

Any dispute or difference relating to the application or interpretation of these Rules must, in the first instance, be the subject of a written complaint sent by registered letter with acknowledgment of receipt to the Organizing Company at the following address: 23 bis Rue du Docteur Paul Bruel, 95380 Louvres, France.

This complaint must be received within a maximum period of thirty (30) calendar days following the end date of the Sweepstakes. The Organizing Company undertakes to examine any complaint and to respond within a period of thirty (30) days from its receipt.

In case of persistent disagreement, any dispute will be brought before the competent courts under the jurisdiction of the Paris Court of Appeal, subject to mandatory legal provisions protecting consumers residing in another country.

In case of contradiction between a translation of these Rules and its French version, the French version prevails.

ARTICLE 1 - OBJET & ORGANISATEUR DU JEU

La société LOFI RECORDS, 23 bis Rue du Docteur Paul Bruel 95380 Louvres France, (ci-après la "Société Organisatrice") organise un jeu de tirage au sort, gratuit sans obligation d'achat (ci-après le "Jeu") dans le cadre de sa collaboration avec Assassin's Creed, dans les conditions prévues exclusivement au présent règlement (ci-après le "Règlement"). Conformément aux articles L.121-36 et suivants du Code de la consommation, ce jeu est entièrement gratuit, sans obligation d’achat, et ouvert à tout participant respectant les conditions du présent Règlement.
Dans le cadre de ce Jeu, la Société Organisatrice attribuera à trois (3) gagnants (ci-après désignés le “Gagnant” ou les "Gagnants"), chacun trois (3) lot tel que défini à l'Article 5 du Règlement.

ARTICLE 2 - MODALITÉS D'ACCÈS AU JEU

Le Jeu est accessible sur les plateformes Instagram, X (anciennement Twitter) et Discord sur les comptes officiels "LOFI GIRL" entre le 8 avril 2025 (18h00 CET) et le 13 avril 2025 (23h59 CET). Le Jeu est sans obligation d'achat et est ouvert à toute personne physique à travers le Monde à l'exception des pays suivants : Corée du Nord, Iran, Syrie, Cuba, Soudan, Crimée, République démocratique du Congo, Afghanistan, Belarus, Russie, Venezuela, et tout autre pays soumis à des sanctions internationales globales.
Sont également exclus les salariés et représentants de la Société Organisatrice, de ses sous-traitants et de ses partenaires ainsi que des membres de leur famille.
Le Jeu s'adresse aux personnes majeures selon la législation de leur pays de résidence. Toute personne mineure souhaitant participer doit obligatoirement fournir une autorisation parentale datée et signée à l'adresse hello@lofigirl.com par le(s) titulaire(s) de l'autorité parentale ou tuteurs légaux. Le parent ou tuteur engage sa responsabilité quant à la véracité de la participation. La Société Organisatrice se réserve le droit de demander la preuve de cette autorisation à tout moment du déroulement du Jeu et pourra annuler la participation du participant mineur dont le représentant légal ne validerait pas la participation.

ARTICLE 3 - MÉCANISMES DE PARTICIPATION AU JEU

3.1 Conditions de participation
Pour participer au Jeu, le Participant doit réaliser les actions décrites ci-dessous sur une des des plateformes mentionnées (une participation par plateforme est autorisée), un tirage au sort aura lieu sur chacun des plateformes :

Sur Instagram :

• Suivre le compte @lofigirl
• Aimer la publication du Jeu
• Identifier un.e ami.e en commentaire sous la publication du Jeu

Sur X :

• Suivre le compte @lofigirl
• Aimer et retweeter la publication du Jeu

Sur Discord :

• Interagir avec le post du Jeu concours en cliquant sur le bouton de participation

Un même Participant est autorisé à participer une fois par plateforme (Instagram, X et Discord), soit un total de trois (3) participations maximum. Chaque participation est indépendante : un Participant ayant complété correctement les actions sur plusieurs plateformes pourra être tiré au sort sur chacune d'elles. Il est donc possible pour un même Participant d'être désigné Gagnant sur plusieurs plateformes, et ainsi de remporter plusieurs Lots, sous réserve du respect des conditions définies dans le présent Règlement.
La participation du participant sera considérée comme complète à condition que toutes les actions requises sur au moins une des plateformes soient cumulativement accomplies. La Société Organisatrice se réserve le droit de vérifier par tous moyens que les participants ont participé au Jeu dans des conditions conformes au présent Règlement. Toute participation qui ne remplirait pas les conditions de participation ou qui comporterait une anomalie ou une incohérence sera déclarée nulle et ne sera pas prise en compte par la Société Organisatrice. La participation au Jeu implique l'acceptation entière et sans réserve du présent Règlement, des conditions d'utilisation des réseaux sociaux Instagram, X et Discord en vigueur ainsi que des règles de leur communauté.

La Société Organisatrice utilise des outils tiers automatisés (tels que app.wask.co et GiveawayBot) dans le but d'assurer l'équité, l'impartialité et la transparence du tirage au sort. Toutefois, elle ne saurait être tenue responsable en cas de dysfonctionnement, erreur technique, panne ou résultat contestable lié au fonctionnement de ces outils, lesquels sont développés et maintenus par des sociétés indépendantes. En participant au Jeu, chaque Participant reconnaît et accepte que la Société Organisatrice ne peut en aucun cas être tenue responsable de tout bug logiciel, anomalie algorithmique, ou résultat généré automatiquement par les outils utilisés. Le recours à ces solutions a pour unique objectif de garantir un traitement équitable et non discriminatoire des participations, sans intervention humaine dans la sélection des Gagnants.

3.2 Informations requises
La participation sur au moins une des plateformes (Instagram, X ou Discord) constitue l'unique mode d'inscription au Jeu. Aucun formulaire de participation supplémentaire n'est requis. En réalisant les actions demandées sur au moins une des plateformes requises, les participants :

• Déclarent avoir pris connaissance du présent Règlement et en accepter les termes sans réserve
• S'engagent à fournir, sur demande de la Société Organisatrice, une preuve d'identité et une autorisation parentale signée pour les mineurs

En cas de désignation comme Gagnant potentiel, sur demande, le participant devra fournir par message privé :

• Ses noms et prénoms
• Sa date de naissance
• Sa ville et son pays de résidence
• Une adresse email valide
• Une adresse postale et un numéro de téléphone pour l'envoi du Lot, le cas échéant
  

ARTICLE 4 - TIRAGE AU SORT & DÉSIGNATION DES GAGNANTS

La désignation des trois (3) Gagnants sera effectuée par tirage au sort réalisé sur chacune des plateforme avec deux outil tiers: (i) l'outil app.wask.co, sera utilisé pour procéder à un tirage au sort sur Instagram et un deuxième tirage sur X, (ii) l’outil GiveawayBot sera utilisé pour procéder à un tirage au sort sur Discord. Chacun des tirages au sort sera effectué parmi l'ensemble des participants ayant correctement réalisé les actions requises sur une des plateformes mentionnées à l'Article 3.1. Les tirages au sort seront effectués dans un délai de cinq (5) jours ouvrés suivant la clôture du Jeu.

Toute décision relative à la désignation des Gagnants et à la vérification des conditions de participation est définitive et ne pourra faire l'objet d'aucune contestation. Si toutes les conditions sont réunies, la Société Organisatrice contactera les participants tirés au sort via message privé sur la plateforme utilisée pour leur participation afin de leur notifier leur sélection et leur demander les informations et justificatifs requis. Ces documents ne seront utilisés que pour vérifier la conformité aux conditions du Jeu et seront supprimés dans un délai maximal de trente (30) jours après la validation des Gagnants. Les justificatifs doivent être transmis sous 72 heures après réception du message. Passé ce délai ou en cas de non-conformité des documents, la participation sera annulée de plein droit, et un nouveau tirage au sort sera effectué pour désigner un autre Gagnant potentiel. La Société Organisatrice analysera les documents fournis dans un délai de 72 heures. Elle pourra, si nécessaire, demander des pièces complémentaires afin de vérifier l'authenticité des informations transmises.
Si la Société Organisatrice confirme que le participant satisfait toutes les conditions d'éligibilité et de validation, il sera désigné Gagnant définitif et se verra attribuer le Lot selon les modalités précisées à l'Article 5 du Règlement.

ARTICLE 5 – ANNONCE DES RÉSULTATS, DOTATIONS & REMISE DES LOTS

5.1 Désignation et annonce des Gagnants
La désignation des Gagnants sera effectuée conformément aux dispositions de l'Article 4 du présent Règlement. Après vérification de leur éligibilité et du respect des conditions de participation, la Société Organisatrice annoncera officiellement les résultats dans un délai maximal de sept (7) jours suivant la clôture du Jeu.

Les noms ou pseudonymes des Gagnants seront publiés sur les comptes officiels de Lofi Girl sur Instagram, X et Discord, et pourront être communiqués par tout autre moyen jugé opportun par la Société Organisatrice.
Les Gagnants seront également contactés par message privé sur la plateforme utilisée pour leur participation (Instagram, X ou Discord). Les Gagnants disposeront d'un délai de soixante-douze (72) heures à compter de la date d'envoi de la notification pour confirmer l'acceptation de leur Lot et fournir les informations nécessaires à son expédition. Passé ce délai, ils seront considérés comme ayant renoncé à leur Lot, lequel pourra être réattribué à un autre participant par un nouveau tirage au sort.

5.2 Dotations
Les trois (3) Gagnants recevront chacun les Lots suivants (3 Lots par Gagnant et par plateforme) :

• 1 Impression Lofi Girl x Assassin's Creed d'une valeur de 79,99$
• 1 Vinyle Lofi Girl x Assassin's Creed Shadows d'une valeur de 34,99$
• 1 Clé numérique du jeu Assassin's Creed Shadows d'une valeur de 69,99$

La valeur des Lots correspond au prix public estimé lors de la rédaction du présent Règlement et est fournie à titre indicatif, sans possibilité de réclamation en cas de variation tarifaire ultérieure.

5.3 Modalités de remise des Lots
L'expédition des Lots physiques (impression et vinyle) sera assurée directement par la Société Organisatrice, à l'adresse indiquée par les Gagnants lors de la confirmation de leur gain. Pour la clé numérique du jeu, celle-ci sera envoyée par email à l'adresse fournie par le Gagnant concerné. Les Gagnants sont seuls responsables de l'exactitude des informations fournies. En cas d'adresse erronée ou incomplète, la Société Organisatrice ne pourra être tenue responsable de la non-livraison du Lot. En cas de non-réception du Lot dans un délai raisonnable, les Gagnants devront contacter la Société Organisatrice.
Pour le Lot consistant en une clé numérique du jeu Assassin's Creed Shadows, les informations techniques suivantes s'appliquent :

- Procédure d'activation : Le Gagnant recevra par email un code unique ainsi que des instructions détaillées pour activer le jeu sur la plateforme correspondante
- Délai d'activation : Le code doit être activé dans un délai de 6 mois après réception
- Support technique : En cas de difficulté d'activation, le Gagnant pourra contacter le service client d’Ubisoft à l'adresse https://www.ubisoft.com/fr-fr/help

5.4 Conditions et restrictions
La clé numérique du jeu Assassin's Creed Shadows sera attribuée sous forme de code d'activation pour la plateforme de jeu choisie par le Gagnant ([PlayStation, Xbox, PC ou via Steam/Epic/Ubisoft Connect, etc.].
Le Gagnant reconnaît que l'utilisation de cette clé numérique peut être soumise à des restrictions d'âge, de contenu ou de disponibilité dans certains pays. La Société Organisatrice ne pourra être tenue responsable en cas d'impossibilité pour le Gagnant d'activer sa clé de jeu en raison de restrictions territoriales imposées par l'éditeur du jeu ou par la législation locale. En cas d'incompatibilité avérée, la Société Organisatrice pourra proposer un lot alternatif de valeur équivalente.
Aucun échange, remboursement ou contrepartie financière ne pourra être demandé en remplacement du Lot attribué. Toute revente ou cession du Lot est strictement interdite. En cas d'indisponibilité d'un Lot pour des raisons indépendantes de la volonté de la Société Organisatrice, celle-ci se réserve le droit de le remplacer par un Lot de valeur équivalente ou supérieure, sans possibilité de contestation.

Les Lots étant attribués à titre gratuit, aucun frais ni taxe ne sera mis à la charge des Gagnants, sauf dispositions légales contraires. 

5.5 Implications Fiscales
La valeur des Lots attribués aux Gagnants est indiquée en dollars américains toutes taxes comprises. Les Gagnants sont informés que ces Lots peuvent, selon la législation fiscale en vigueur dans leur pays de résidence, être soumis à déclaration ou imposition.

Pour les résidents fiscaux français : Conformément à la réglementation en vigueur, les Lots reçus dans le cadre de ce Jeu sont susceptibles de constituer un avantage en nature soumis à déclaration fiscale si leur valeur dépasse les seuils d'exonération prévus par la législation. Pour les résidents fiscaux d'autres pays : Les Gagnants sont seuls responsables de vérifier auprès des autorités fiscales de leur pays de résidence les obligations déclaratives éventuelles liées à l'obtention de ces Lots et d'acquitter, le cas échéant, tout impôt ou taxe qui pourrait être dû. La Société Organisatrice ne saurait être tenue responsable des obligations fiscales incombant aux Gagnants.

ARTICLE 6 – PUBLICITÉ & UTILISATION DES PSEUDONYMES DES GAGNANTS

En participant au Jeu, les Gagnants autorisent expressément la Société Organisatrice à utiliser et diffuser leur pseudonyme Instagram, X ou Discord à l'exclusion de toute autre donnée personnelle, dans le cadre des communications relatives au Jeu et à des fins promotionnelles. Cette autorisation est consentie à titre gracieux, sans que les Gagnants ne puissent prétendre à une quelconque rémunération ou contrepartie en échange de l'exploitation de leur pseudonyme. Les Gagnants acceptent que leur pseudonyme soit diffusé, pour le territoire du Monde, sur les supports suivants :

• Réseaux sociaux : Instagram, X, Facebook, YouTube, TikTok et autres plateformes officielles de la Société Organisatrice
• Site internet : www.lofigirl.com
• Médias tiers : communiqués de presse, articles promotionnels et tout support de communication lié au Jeu

Cette autorisation est valable pour une durée de trois (3) mois à compter de la date d'annonce des Gagnants. Les Gagnants conservent la possibilité de s'opposer à la publication de leur pseudonyme en formulant une demande écrite auprès de la Société Organisatrice à l'adresse suivante : hello@lofigirl.com au plus tard dans un délai de trois (3) jours suivant l'annonce des résultats.

ARTICLE 7 : DONNÉES PERSONNELLES – AVIS DE PROTECTION DES DONNÉES

Dans le cadre de l'organisation du Jeu, la Société Organisatrice, agissant en qualité de responsable du traitement au sens du Règlement Général sur la Protection des Données (Règlement (UE) 2016/679 – "RGPD"), collecte et traite les données personnelles des participants afin de gérer leur participation, identifier les Gagnants, attribuer les Lots et assurer la transparence du Jeu, notamment par la publication des pseudonymes des Gagnants sur les comptes officiels « LOFI GIRL ». Ce traitement repose sur l'exécution du présent règlement, conformément à l'article 6(1)(b) du RGPD, et sur l'intérêt légitime de la Société Organisatrice, en vertu de l'article 6(1)(f) du RGPD, pour la communication des résultats et la gestion des obligations comptables et fiscales.

La participation au Jeu implique la collecte et le traitement des données suivantes : pseudonyme sur les réseaux sociaux et, pour les Gagnants uniquement, nom, prénom, date de naissance, ville et pays de résidence, ainsi que l'adresse e-mail et l'adresse postale. Ces données sont strictement nécessaires à la gestion du Jeu, et leur non-fourniture entraîne l'impossibilité de valider la participation ou de recevoir le Lot. Les données personnelles collectées sont destinées exclusivement à la Société Organisatrice et non aux réseaux sociaux Instagram, X ou Discord, dans le seul et unique but d'organiser et de veiller au bon déroulement du Jeu ainsi qu'à l'attribution des Lots. Ces données personnelles ne font l'objet d'aucune vente, cession ou transfert à des tiers à des fins commerciales ou publicitaires. Toutefois, la Société Organisatrice peut être amenée à transmettre certaines données à des prestataires techniques ou logistiques, agissant en qualité de sous-traitants au sens du RGPD, pour assurer notamment, le tirage au sort, l'hébergement du site du Jeu et la livraison des Lots. Les données personnelles des participants sont conservées pour la durée du Jeu et jusqu'à l'attribution effective des Lots.

• Données des participants non gagnants : supprimées trois (3) mois après la clôture du Jeu
• Données des Gagnants : conservées jusqu'à six (6) mois après la livraison des Lots, sauf obligation légale imposant une durée plus longue
• Données nécessaires au respect des obligations comptables et fiscales : conservées pendant cinq (5) ans, conformément à la législation en vigueur

La Société Organisatrice met en œuvre des mesures techniques et organisationnelles appropriées afin de garantir un niveau de sécurité adapté au risque encouru pour les droits et libertés des participants.

En application du RGPD et de la loi Informatique et Libertés du 6 janvier 1978 modifiée, chaque participant dispose des droits suivants sur ses données personnelles : droit d'accès, droit de rectification, droit d'effacement (sous réserve des obligations légales de conservation), droit à la limitation du traitement, droit à la portabilité et droit d'opposition pour des raisons tenant à sa situation particulière. Toute demande d'exercice de ces droits doit être adressée à la Société Organisatrice :

Un justificatif d'identité pourra être demandé pour éviter toute usurpation. Les participants disposent également du droit d'introduire une réclamation auprès de la Commission Nationale de l'Informatique et des Libertés (CNIL) s'ils estiment que leurs droits ne sont pas respectés.

ARTICLE 8 : RESPONSABILITÉS & RÉSERVES

La responsabilité de la Société Organisatrice est strictement limitée à l'attribution des Lots valablement remportés conformément aux dispositions du présent Règlement. La Société Organisatrice ne pourra en aucun cas être tenue responsable des conséquences liées à l'utilisation, la jouissance ou la non-utilisation des Lots attribués aux Gagnants.

Le Jeu étant organisé sur les plateformes Instagram, X et Discord, les participants reconnaissent expressément être soumis aux conditions générales d'utilisation de ces plateformes ainsi qu'à leurs règles de communauté en vigueur. La Société Organisatrice ne pourra être tenue responsable de toute suspension, suppression ou restriction de compte décidée unilatéralement par ces plateformes en raison d'un manquement du participant aux règles en vigueur. La Société Organisatrice ne pourra être tenue responsable des fraudes, tricheries ou manœuvres déloyales commises par l'un des participants. Toute fraude, tentative de fraude, tricherie ou manœuvre déloyale visant à altérer le bon déroulement du Jeu entraînera l'exclusion immédiate du participant concerné, sans préjudice d'éventuelles poursuites judiciaires.
Est notamment considérée comme une fraude, sans que cette liste ne soit exhaustive :

• L'usurpation d'identité
• L'utilisation de faux comptes ou de bots
• La participation multiple sous différentes identités
• Toute forme de manipulation visant à augmenter artificiellement ses chances de gagner

La Société Organisatrice se réserve le droit de mener toute vérification nécessaire afin de s'assurer de la loyauté des participations. Toute exclusion d'un participant sera définitive et sans possibilité de recours, sauf en cas d'erreur manifeste de la Société Organisatrice.
La Société Organisatrice s'efforcera de garantir un accès continu au Jeu via ses comptes officiels. Toutefois, elle ne saurait être tenue pour responsable en cas d'interruption, de suspension ou de suppression du Jeu, notamment en raison de problèmes techniques affectant les plateformes, Internet ou les serveurs d'hébergement.

ARTICLE 9 : FORCE MAJEURE ET CIRCONSTANCES EXCEPTIONNELLES

La responsabilité de la Société Organisatrice ne saurait être engagée si, pour un cas de force majeure ou indépendant de sa volonté, le Jeu devait être modifié, écourté ou annulé.
Sont considérés comme cas de force majeure, au sens du présent Règlement, les événements présentant les caractéristiques d'imprévisibilité, d'irrésistibilité et d'extériorité, tels que notamment ; Catastrophes naturelles, épidémies, incendies, inondations ; Attentats, guerres, troubles civils ou sociaux ; Restrictions gouvernementales ou légales; Pannes d'électricité généralisées ou défaillances des réseaux de télécommunication; Fermeture ou modification majeure des plateformes utilisées pour le Jeu ; Toute autre circonstance rendant impossible ou particulièrement difficile la poursuite du Jeu ou la remise des Lots

En cas de survenance d'un événement de force majeure, la Société Organisatrice informera les participants dans les meilleurs délais et pourra, à sa discrétion, prolonger la durée du Jeu, modifier certaines modalités ou annuler le Jeu si les circonstances l'exigent.

ARTICLE 10 : PUBLICATION & CONSULTATION DU RÈGLEMENT

Le présent Règlement du Jeu est établi par la Société Organisatrice et mis à disposition du public de manière libre et permanente pendant toute la durée du Jeu. Il peut être consulté et téléchargé à tout moment sur le site officiel de la Société Organisatrice (https://lofigirlshop.com/pages/lofi-girl-x-assassins-creed) et peut être obtenu sur simple demande écrite adressée à la Société Organisatrice par e-mail à hello@lofigirl.com.

Toute modification du Règlement fera l'objet d'un avenant, qui sera publié selon les mêmes modalités que le Règlement initial. Une version horodatée et archivée du Règlement sera conservée par la Société Organisatrice à des fins de preuve, et pourra être communiquée à tout participant en cas de contestation.

ARTICLE 11 : ACCEPTATION DU RÈGLEMENT

La participation au Jeu implique l'adhésion sans réserve et irrévocable au présent Règlement, à ses clauses, ainsi qu'aux éventuels avenants. Toute fraude, tentative de fraude ou manquement au respect des conditions définies dans le présent Règlement entraînera l'exclusion immédiate du participant, sans préjudice des éventuelles poursuites judiciaires que la Société Organisatrice pourrait engager à son encontre.

ARTICLE 12 : LOI APPLICABLE ET LITIGES

Le présent Jeu et son Règlement sont exclusivement régis par la loi française, sous réserve des lois impératives du pays de résidence du participant, lorsque ces dernières lui accordent une protection légale spécifique qui ne peut être écartée par un Règlement de Jeu étranger.

Conformément aux dispositions de l'article L.211-3 du Code de la consommation, en cas de litige de consommation, le participant peut saisir gratuitement le médiateur de la consommation dont relève la Société Organisatrice.

Toute contestation ou différend relatif à l'application ou l'interprétation du présent Règlement devra, en premier lieu, faire l'objet d'une réclamation écrite adressée par lettre recommandée avec accusé de réception à la Société Organisatrice à l'adresse suivante : 23 bis Rue du Docteur Paul Bruel, 95380 Louvres, France.

Cette réclamation devra être reçue dans un délai maximum de trente (30) jours calendaires suivant la date de fin du Jeu. La Société Organisatrice s'engage à examiner toute réclamation et à y répondre dans un délai de trente (30) jours à compter de sa réception.

En cas de désaccord persistant, tout litige sera porté devant les tribunaux compétents relevant de la Cour d'Appel de Paris, sous réserve des dispositions légales impératives protégeant les consommateurs résidant dans un autre pays.
